The new bill wey dem dey call Transgender Persons (Protection of Rights) Amendment Bill for 2026 dey threaten to remove some important rights wey Supreme Court don give transgender pipo since 2014.
For 2014, Supreme Court for India give landmark judgment for case wey dem call National Legal Services Authority versus Union of India. That judgment say transgender pipo get right to choose their own gender identity without anybody to disturb dem. But this new bill wey dey come now want to change everything.
The main problem na say the bill go narrow who dem go consider as transgender person. E go exclude many pipo wey no fit into male or female category, like non-binary pipo, gender-fluid pipo, and some intersex pipo. Instead of self-identification wey dey before, pipo go need medical proof and certificate from Medical Superintendent or Chief Medical Officer before District Magistrate fit approve am.
Another serious matter na say the bill go create “medical boards” wey go dey certify gender identity. These boards go dey headed by Chief Medical Officer or Deputy Chief Medical Officer, and dem go need to recommend before District Magistrate fit issue certificate. This one dey make transgender identity look like sickness wey need medical treatment.
For 2019, dem pass Transgender Persons (Protection of Rights) Act wey allow pipo to apply for recognition based on how dem see themselves. If dem later decide to do surgery, dem fit apply for new documents. But this 2026 amendment go put medical board as first step, meaning self-perception no go count again.
The bill still dey add new criminal offences. For 2019 Act, Section 18 dey criminalize things like forcing transgender person to do bonded labor, denying dem access to public places, or abusing dem. The new bill keep these ones but add new offences like forcing person to “assume, adopt, or outwardly present a transgender identity.p>
Activists dey worry say police and government fit misuse these new laws. Dem no clearly define wetin mean to “dress, present, or conduct themselves outwardly as a transgender person.” This one fit affect traditional community structures like hijra gharanas wey dey give shelter and support to transgender pipo wey their family don abandon.

The bill still never become law, so dem fit still change am. E fit pass through lower house of Parliament, or government fit withdraw am, or dem fit send am to Parliamentary Standing Committee wey go examine am well. Another way na through court case if the bill become law, but cases against 2019 Act still dey pending for Supreme Court since 2019.
Many human rights organizations and activists dey call the bill “unconstitutional” and “dangerous.” Dem say e dey go against the NALSA judgment wey Supreme Court give. Transgender pipo dey fear say their privacy go reduce and dem go face more discrimination if this law pass.
