Abuja, Nigeria – The Supreme Court on Friday take big decision wey shock many for Nigeria politics. Dem don overturn the judgments wey the Court of Appeal and the Federal High Court give, making Senator Samuel Anyanwu the National Secretary of the People’s Democratic Party (PDP) again.
This five-member panel of the apex court talk say who dey hold the position of PDP National Secretary na matter wey concern the party internal affairs. Dem reason am say e no suppose dey for court judgement, so dem no go fit intervene.
Justice Jamilu Tukur wey carry the lead judgement, strike out di lower court ruling wey happen for October 2024. Him also set aside di Court of Appeal majority judgment wey support Anyanwu removal from di PDP post last December.
Dem also uphold di dissenting opinion of Justice Ekanem wey earlier talk say di trial court judgment no make sense because of jurisdiction wahala.
Furthermore, di Supreme Court notice say di plaintiff, Aniagu Emmanuel, wey file di case, no get legal standing to do so. Him fail to show wetin concern him with di matter, especially how di identity of PDP National Secretary affect am.
Dis ruling no be only victory for Senator Anyanwu; e also show clear boundary wey judiciary fit fit intervene for internal matters of political parties.
As matter start, Anyanwu wey relinquish him position to contest as governor for Imo State wey him no win, don sue di PDP leadership di way dem no allow am return to in position after him defeat.
Anyawu argue say he suppose return to di office wey he resign from. E call di Supreme Court to void di earlier judgments wey don remove am as di PDP National Secretary.
But Chief Paul Erokoro, wey represent Aniagu Emmanuel, put counter-argue say Anyanwu’s request dey against di PDP Constitution. E maintain say since Anyanwu don resign, he no fit go back to di position again.
Dry matter no finish there! Di 4th respondent, Ali Odeifa, also put mouth talk wey dem reject Anyanwu’s attempt to reclaim im position. Odeifa, through im lawyer Okwudili Anozie, tell di apex court say dem suppose dismiss Anyanwu’s case because e dey frivolous, baseless, and lack merit.
During di case, Justice Emmanuel Akomaye Agim ask whether di Supreme Court fit even get jurisdiction over di PDP leadership. Erokoro respond say di court dey inconsistent for some similar cases.
We see say di Federal High Court and di Court of Appeal for Enugu don earlier rule to remove Anyanwu as PDP National Secretary. Di Court of Appeal last December don uphold di High Court ruling and confirm Chief Sunday Ude-Okoye as di substantive National Secretary for di party.
Di appellate court judgment declare say Anyanwu’s appeal no get ground and no make sense because he don violate di PDP Constitution by claiming di National Secretary position after e don contest and come out as di PDP candidate for di 2024 Imo State governorship election.
