Mahakamai ta Supreme ta India ta ranar Alhamis, 7 ga watan Nuwamba, 2024, ta umarce rai da aiyukan kamfanin jirgin saman na Jet Airways, bayan da kamfanin Jalan-Kalrock Consortium (JKC) bai cika sharadin tsarin sulhuli ba.
Mahakamai ta yi amfani da ikon ta na musamman karkashin doka ta 142 ta katangar da umarnin da Hukumar Tambayoyi ta Kasa ta Shari’a (NCLAT) ta bayar, wadda ta amince da tsarin sulhuli na JKC na canja mallakar Jet Airways ba tare da biyan diyya ga masu bashi ba.
Kamfanin JKC, wanda ya hada Murari Jalan, wani dan kasar Indiya mai zama a Hadaddiyar Daular Larabawa, da Florian Fritsch, wani jami’in kamfanin Kalrock Capital Partners Limited, ya gaza cika sharadin tsarin sulhuli, wanda ya hada da biyan kudin farko na ₹350 crore.
Mahakamai ta ce aniyar da JKC ta kasa biyan diyya ga masu bashi, wanda ya hada da Bankin Jihar Indiya (SBI) da Bankin Kasa na Punjab, ya sa ta zama dole ta umarce rai da aiyukan kamfanin.
An yi ikirarin cewa JKC ta biya kawai ₹200 crore daga cikin ₹350 crore na kudin farko, wanda ya kasa cika sharadin tsarin sulhuli. Mahakamai ta kuma ce aniyar da JKC ta kasa biyan diyya ga ma’aikata na kamfanin da sauran masu bashi ya sa ta zama dole ta umarce rai da aiyukan kamfanin.
Mahakamai ta kuma sanya umarnin ayyana liquidator don gudanar da rai da aiyukan kamfanin, inda ta ce aniyar da JKC ta kasa cika sharadin tsarin sulhuli ya sa ta zama dole ta umarce rai da aiyukan kamfanin.
