Court don bar PDP NEC and BoT from sacking Umar Damagum as de acting National Chairman of de party. Dis decision come from Justice Peter Lifu of de Federal High Court in Abuja on Friday, October 11.
Justice Lifu give dis order in response to a suit filed by Senator Umar El-Gash Maina, who claim say some stakeholders dey hold secret meetings to remove Damagum from office. Maina, who be de chairman of PDP in Yobe State, allege say dem want replace Damagum with Phillip Salawu, former Deputy Governor of Kogi State.
Justice Lifu rule say according to Articles 42, 47, and 67 of PDP Constitution, national officers can only be elected during de party’s national convention. He emphasize say any attempt to remove Damagum without national convention or court order go violate PDP Constitution.
Maina submit two letters to de national secretary, Samuel Anyanwu, about de secret meetings, but dem no take any action. Justice Lifu hold say Maina have sufficient interest and justiciable cause to institute de case because he display his PDP membership card and raise fundamental issue of protecting PDP Constitution.
De court also dismiss de opposition from de defendants say Maina no get locus standi to bring de case and say de court lack jurisdiction. Justice Lifu affirm say Damagum remain de recognized national chairman until de party’s national convention scheduled for December next year.
