UNSMIL warns against acts that could serve to deprive Libyans of exercising their democratic right

UNSMIL reiterates its appeals to the relevant parties and authorities to take all possible measures to facilitate the work of the judicial system with full respect for its independence.

The United Nations Support Mission in Libya (UNSMIL) follows with great concern the continued closure of the Sebha Court of Appeal, in addition to the reported threats against the judiciary. An armed group, allegedly affiliated with the forces controlling Sebha, has reportedly once again violently obstructed the work of the Sebha Court of Appeal. Reports also indicate that judges were physically prevented from carrying out their legally entrusted functions, which directly impeded the electoral process.

UNSMIL is also alarmed by increasing reports of intimidation and threats against judges and judicial employees, particularly those dealing with election-related complaints, as well as candidates, in various locations in Libya. UNSMIL strongly condemns all acts designed to jeopardize the integrity of the electoral process and prevent Libyans from exercising their democratic rights in conditions of safety and dignity.

The Mission reminds all parties involved in the obstruction of the judicial system that they are subject to criminal responsibility under Libyan law (code of criminal procedure and Law No. 1 of 2021 on presidential elections) and may be subject to sanctions in accordance with relevant resolutions of the United Nations Security Council. .

UNSMIL reiterates its appeals to the relevant parties and authorities to take all possible measures to facilitate the work of the judicial system with full respect for its independence. Urges all relevant security authorities to ensure equal access to due process for all candidates and to ensure the safety of judges and judicial employees.

The mission reiterated its commitment to hold parliamentary and presidential elections, according to the roadmap of the Libyan Political Dialogue Forum and as established in UN Security Council resolution 2570 (2021). It requests the authorities and institutions to take all necessary measures to ensure the holding of both elections as a free, fair, inclusive and credible process, without intimidation or obstruction of security conditions. The Mission warns against any action that could deprive Libyans of their right to democratically elect their representatives and undermine the holding of free, fair, inclusive, credible and transparent elections.
