Peter Obi files petition against Bola Tinubu’s presidential election victory

Peter Obi, the presidential candidate of the Labour Party has taken legal action against Bola Tinubu of the All Progressives Congress (APC) after he was declared the winner of the 25 February presidential election. At the Presidential Election Petition Court in Abuja, Mr. Obi formally filed his petition on Tuesday to challenge the electoral commission’s decision to declare Tinubu as the victor.

INEC declares ballot results

The Independent National Electoral Commission (INEC) declared Mr. Tinubu the winner of the election having scored majority votes (8,794,726 votes) and at least 25 per cent of votes in 29 states. Tinubu took the victory over Atiku Abubakar of the Peoples Democratic Party (PDP) who came second in the election with 6,984,520 votes. Mr. Obi came third with 6,101,533 votes.

Obi seeks five prayers from the court

In his petition, Mr. Obi sought five prayers from the Presidential Election Petition Court. The Labour Party candidate’s prayers include a declaration that the election held on February 23 was invalid and unlawful due to non-compliance with the Electoral Act 2010 as amended. He is also seeking an order mandating the court to nullify the election and to order a fresh one that conforms with the provisions of the Electoral Act 2010 as amended.

Mr. Obi is further seeking an order nullifying the presidential election results in all the states that were also affected by non-compliance with the Electoral Act. He is asking for an order directing INEC to conduct a fresh election in those states within 90 days from the day that the order is given. Finally, he is asking for such further orders as the court may deem fit to make in the circumstances.
