This landmark decision involve Mohamed and Marie-Anne Bakhaty, wey live for their £2 million property near The Westgate School. The couple don suffer from stray balls wey dey fly over their fence, disturbing their peace and enjoyment of their garden.
Dem complain say since the school build all-weather five-a-side football pitch in 2021, balls dey land for their garden every other day, making dem no fit enjoy their swimming pool. Mrs. Bakhaty, 66, say she don see 170 balls land for her garden within 11 months.
“It dey make my life miserable,” she talk. “Noise from balls wey dey hit fence don turn our outdoor space into ‘no-go zone’.”
Despite school don put net to reduce stray balls, the Bakhatys still dey complain say dem no fit live peacefully and dem even sue Hampshire County Council, wey manage the school, claim say dem right to enjoy their home dey violated.
Judge Philip Glen wey handle the case talk say he understand di couple tiff, but he also find say dem don experience substantial interference to their lives from di constant ball intrusion.
“Occasional stray ball fit dey annoying, but di frequency wey balls dey come over di fence dey cause real nuisance,” he talk.
